Rajiv Mani urges shift towards arbitration for dispute resolution
Rajiv Mani, Secretary (Legislative Department) at the Ministry of Law and Justice, called for a shift in mindset towards alternative dispute resolution methods, particularly arbitration, during the valedictory session of the Indian Institute of Corporate Affairs (IICA) Certified Arbitration Programme (ICAP) on Tuesday. He highlighted arbitration’s importance as a dispute resolution tool, aside from traditional court litigation, and noted that India’s Constitution makers had favored arbitration in certain matters during the country’s transitional period.
The event, held at the IICA Campus in Manesar on October 12, aimed to build a new generation of global arbitration professionals. Former law secretary P.K. Malhotra acknowledged India’s arbitration potential but raised concerns about the lack of a supporting ecosystem, calling for the establishment of the Arbitration Council of India. Justice Hemant Gupta, Chairperson of IIAC, emphasized the need for institutional arbitration to ensure efficient proceedings, while IICA’s Director-General, Gyaneshwar Kumar Singh, stressed the importance of standardizing the arbitration landscape and addressing enforceability issues.
